Koger & Partnerid AS

This site has only one intention, and that is to make public all issues around the company Koger & Partnerid AS in Bergen, Norway (Norra). Late in 2008 I did move two tank's for Koger & Partnerid (AS) at Alexela's tankfarm in Sløvåg, just beside Mongstad. After this job I was asked to give a price on the work to lift a tank (Tank 56). To do this correct, I agree'd with Mr. Jorma Arukase to make a detailed plan on site. This was execute, and I then did stand by to do the job not only once, but two period's. One late in 2008 and then again in the beginning of 2009. After some time I did discover that the work had allready been executed by someone else without letting me know. Okey, shit happen. A bill to claim my cost's then was sent to the company (just the cost of one day travel and survey), with no result. More reminder's was also sent, still without any result. I then sent the claim to the minor civil court (Forliksrådet) in Bergen. The next 9 monts the claim was sent from one office to another without any result. I have now redrawn the claim from the minor civil court, and started my own proceedings to claim the payment. So far I can not see any willpower from any of the recipient's of my E-mails, exept for some reading-confirmation's. The next stepp will be to add all E-mail correspondence between Mr. Jorma Arukase, Object Manager Norway, objektijuht Norra (Est). One thing will be for certain, we will never vork for a NUF-registrated company again, unless the complete job is pay'd in advance. And I belive the knowledge around NUF-companies will be more known in the future.

Today I think I will not do to much. But I have one issue to check out. If a company are registered as a NUF-Company, and represent it self as a AS, is this a crime?

Just checking how you all are today. I have had the pleasure to receive received-receipt from some of you, but no answers on my claim. Due to this I will proceed with futrher action to obtain my claim. At a sertain point I belive I will exceed the value of my claim, compared in negative effect's to your participation in Norwegian business. However, it may be difficult to know when this point has been passed, and I therefore again give you the possibillity to take actions to prevent any further measures from me.

Up to this point I have used 9 monts just to learn that the formal claim to the minor civil court only came back with more paperwork, and it also did demonstrate how little responsibility a NUF-registrated company realy do have.

My next step will be to look into Mr. Jorma Arukase's document's from the start of our co-operation. In his first E-mail he did  sign with the following text:

As you all can see, he did use the letters AS in the company name,  which he also did repeat in further E-mails. According to the Norwegian rules, it is against the law to use the letters "AS" if you are not a limited company according to the law. A NUF (Norwegian Abroad Company) is not a AS. Hopefully this dispute will be setled by payment from Koger Partnerid Estonia, but I can assure all of you that I will not stop the action before so have happend, or I know my strugle have had effect against your company. I even may go to further lawsuits, based in Mr. Jorma Arukase's E-mails. My claim is just a small issue. compared to the work we did aggre to do, and  which i not only once, but twice was cheated in. The complete story will be my next step to make public, including all correspondence between Mr. Jorma Arukase and my self. Also my offer to him will be attached. To have top effect, all further actions will be on my web-site, and then easily accessible for general public.

At last, the invoice has been raised a little bit, I just do not work for free. And this will happen every time I have to write to you, no matter where I do this. So it may take a while before we are even. My best advice is to pay out..... And again, this is not a threaten, but only information. There is no law against writing about facts.

In 2009 i did perform some work for your division in Norway, and I have had problems to obtain agreement with your local representative, Mr. Jorma Arukase. The balance between the Norwegian division, Koger & Partnerid AS c/o AMESTO BUSINESS PARTNERS AS O.J. Brochsgate 16A 5006 BERGEN" do not want to have a bad reputation in Norway, or any else place in the world, and therefor would like to give you a possibility to settle the dispute. A new invoice will be attached to this mail. If the invoice is not paid, I am sorry that I will have to inform all my joint venture partners about your division in Bergen, to prevent other from having the same problems. My visit to make a detailed plan was complete in line in a understanding
that I was going to execute the jacking of tank 56. I also did wait for a
period in november/december 2008, just to start on the work. Then again in
the beginning of 2009 we again did some planning in when to execute the
lifting of tank 56.
After this I did not hear anything from you, unntil I heard from other that
the work had been done.
I belive all correspondence we have by E-mail will remove any doubt in this
matter. I can see no reason to drop my claim, and will proceed with a claim
to the minor civil court (forliksrådet), if the invoice is not paid.

I have been waiting to hear from you, and some days ago I did contact the Alexele at Sløvåg to try to contact you. I then did get the information that the work with tank 56 was allready performed. This gives me the understanding that there will not be any work to execute for my company. Before I did send you the offer on lifting of tank 56, I did execute a Survey/Inspection at Sløvåg the 5 November 2008, on request from you. The costs on this day I hope you will accept, and I hereby send you a invoice regarding my costs.

In November/December 2008 I did wait for the work to be set in work, and also in 2009 we did have correspondence regarding the work. It would had been expected a notice to let me know that my services would not be requested any more. However, I do not want to start a discustion on the matter, I will rather look forward, and hope you will use my company in any future project's.

I have allready aggree'd with Stangeland Kran to be able to do this job with
tank 56. I know I will be away on a crane-job the next 3 week's. After this
job, I hope we may do the jacking. That will be sometime in week 13 (23 - 27
Mars).
If this time will be ok for starting the work, I think we must go for this
week, or the next week (the week before eastern).
Like I said before, I need 2-3 days to prepare the equipment. Then it's
depending on weather-conditions. If good weather, the complete rigging and
jack-up id done in one week. To jack down is not so much depending on
weather, and may be done in a few days.
 
If you need more time before you can have the tank 56 lifted, please let me
know. The down-jacking I think I will find time to do, when you are ready
with the work underneeth. I may then use a weekend as well.
 
The time you need between jack-up and jack-down is not any problem, you may
use the time you need.

I will look forward to hear from you again, and hope this plan will bo at
your satisfaction.

It have taken some time to work out a solution with the company I work for
now, Stangeland Kran AS. I have an aggree with them, I will be able to
execute the liftin of tank 56 for you. We just need to find the time that
will be fine both for you and my self/Stangeland Kran AS.
I have changed the date in my offer from last year, amd by this confirm that
the offer are still valid.
 
When you have some more details regarding the prefered time for the jack-up,
I will do my best to do the lifting at that time.

I got the impression that the work to lift tank 56 would be execute as soon as possible, and have been waiting for you to contact me again. After the inspection of tank 56 the 5th. November, I talked with you, and did understand that you was working with this, and just needed a few days. You also confirm that my offer on this work was definitively of interest for you, and that we had business going on. Based on this information, I did get the understanding that the work would start soon, and have not engaged other works.
If the work is starting soon, please inform me, so I may make the correct strategic decision in what to do. If I engage in other work, this may have effect on the time needed to mobilize at your project again. This will depend on the other works extents.

Dear Mr. Jorma Arukase.

I kindly recommend you to accept invoice no. 718, sent to you by e-mail the 14 October. In your e-mail to me, sent from you the 15 October, you refuse to accept the invoice no. 718, based on one-sidedness details regarding time to move the two tanks. On my side I am able to find several factors that will benefit my situation. I will list some of these factors here.

 

1. The contract was to be confirmed by an advance payment, 30% of contract. This payment was fully paid 27/8. In the offer I requested 14 days after this payment to mobilize. Out of this the first day to count in your numerical example of used time will be 7 days after this again. Now we are allready far out in September, 17 September to be exact. Any way the time-consumption was only an estimate, and also all on my cost.

 

2. Allready when you asked for a fixed price, I wrote that there could be some element of uncertainly, but I would let the estimated price be a fixed price.

 

3. Out from this information, the first tank allready was in place in good time. And the haste on next tank arice when we started on this tank. I ask myself why you did use 2 monts to give me the job, if all must be in such a hurry.

 

4. In the description in the job, there should be "Cut-out's" in the foundations for jacking-equipment. This we aggreed to work without, and to make the down-jacking by extra equipment/methode. All things take it's time, also this detail.

 

5. The surface between tank's and foundation was far from leveled, which make all work to move equipment more demanding. However I did not complain on this, we just did the work to move the tanks. You may just take a look around the cite, and you will find that I could not expect any better work in making surfaces leveled. (No further coments)

 

6.  In the skid-area for tank 3 there was made some small foundations for a pipe-line. This was agree on between me and the company that execute this work. However I had to work with this area approximately one day to make the surface applicable.

 

7. When we was almost down with the first tank, we had to lift it again to let you fill more sand, and we also did most of this work, all without complaining. This work also make the job last one day more.

 

8. One day we did wait for the canteen almost a half day.

 

9. Once the forklift was out of order, and made the work stop for some time. I myself did some work on the forklift, and continued the work.

 

10. Weather-conditions always do have influence on work, even at Sløvåg. Some of the welding-work did take time because there had to be made shields for wind and rain.

 

11. Even all the work is done like "Hasty-work", it took about 2 weeks before anyone did use tank 4 (first to move), and tank 3 is still not used at all.

 

12. I may have forgotten some details, but I hope this will be satisfactorily. At last I must remind you that the job was fully a "Fixed-price-contract", without any day penalty ore any other claim regarding time-consuming.

 

I find it far from attractively to have to do this work, to claim payment for a demanding job that have been carry out without any accident or injury. It also takes the time I do not have. In fact my wifes mother did die today, and I would like to join her in the funeral first Sunday in Thailand, but can not travel without money, and with 288.000 NKR in amount outstanding, the result says itself.

I again kindly request you to accept the invoice no. 718 (attached agaain).

If you confirm this immediately (today), I am willingly to forget the subject. Payment must then be carry out instantaneously. I may then travel with my wife to Thailand on Thursday. If the invoice is not paid within 7 days, I will go on with legal process, and request the court for an originating summons. Also I will make use of any other legal means to effort my claim.

About invoice: then you should give the invoice also 9 oktober but get invoice from you  13 october and also it wasnt officiali correct.
We talk on the phone also about discount recarding contract where are writen that moveing two tank takes 5-7 days but it takes all most 40 days.

I m sorry I cant accept invoice before we havent taken conversatsion with you.

You need to lift tank up 1,5 m and secure before workers going under the tank. When work is done you lift down.
